1. The Service
BeneficIQ is a business-intelligence and operations platform that helps you manage clients, financials, marketing, scorecards, and reporting, including by connecting third-party services you authorize (such as Intuit QuickBooks Online, GoHighLevel, and Stripe) to display analytics within your workspace.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. You may not copy, modify, reverse engineer, resell, or create derivative works of the Service except as permitted by law.
3. Accounts and Eligibility
You must provide accurate account information and are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 years old and use the Service for business purposes. Notify us promptly of any unauthorized use.
4. Acceptable Use
You agree not to use the Service to:
- violate any law or third-party right;
- upload malicious code or attempt to disrupt or gain unauthorized access to the Service or its data;
- access data you are not authorized to access; or
- use the Service in a manner that breaches the terms of any connected third-party service.
5. Third-Party Integrations
The Service lets you connect third-party services. When you authorize a connection, you permit BeneficIQ to access and process data from that service to provide the Service to you. Your use of each third-party service remains subject to that provider's own terms and privacy policy (for example, Intuit's terms for QuickBooks Online). We are not responsible for third-party services, and you are responsible for your accounts with them. You may disconnect any integration at any time.
6. Your Data
As between you and us, you retain all rights to the data you provide or that we access from your connected accounts (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service for you, as described in our Privacy Policy. We do not sell Customer Data.
7. Intellectual Property
The Service, including its software, design, and content (excluding Customer Data), is owned by Benefic Marketing LLC and its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
8. Fees
If the Service is offered to you on a paid basis, applicable fees and billing terms will be presented at sign-up or in a separate order. Unless stated otherwise, fees are non-refundable except as required by law.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any financial figures derived from connected services are accurate or complete. BeneficIQ is not an accounting, tax, legal, or financial-advisory service, and its outputs are for informational purposes only.
10. Limitation of Liability
To the maximum extent permitted by law, Benefic Marketing LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months preceding the claim, or US $100 if you have not paid us.
11. Indemnification
You agree to indemnify and hold harmless Benefic Marketing LLC from claims, damages, and expenses arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law.
12. Term and Termination
These Terms apply while you use the Service. You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Upon termination, your license ends; provisions that by their nature should survive will survive.
13. Governing Law
These Terms are governed by the laws of the United States and the State of Texas, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Texas, unless otherwise required by applicable law.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
